Volusia County FL Correctional Facility

The Volusia County Jail is headed by the Volusia County Corrections Director, Mark Flowers.  Larry Landgon is the warden.  There are two different jail facilities in the Volusia County Jail system: the Volusia County Correctional Facility and the Volusia County Branch Jail.  While both of these facilities are county-level detention facilities, they are designed to serve different purposes.  Those who are detained, but who have not faced trial, generally go to the Volusia County Branch Jail facility, which is similar to a holding facility.  This is where inmates are taken after being arrested, held while bail is being determined, and detained until they can make a first appearance.  In contrast, the Volusia County Correctional Facility is designed for inmates who are post-conviction.  They may be inmates serving out their sentences at the facility or inmates awaiting transfer to another facility.

Inmate processing is more rapid in Volusia County than it is in many places throughout the U.S., which results in shorter jail times for defendants who will be released on bail or on their own recognizance.  Within 24 hours of being detained, an inmate goes for a hearing.  At the hearing, the judge decides whether the inmate will be detained in the facility, released on his or her own recognizance, or released on bail.  Once an inmate has attended his or her first court appearance, the inmate goes to Case Management orientation where he or she is placed in a housing unit based on criminal history and criminal charges.  This classification is not permanent and may change during the jail stay, depending on the inmate’s behavior or changes.  In addition, each housing unit has a case counselor, and, if an inmate needs the counselor’s assistance, they can access the counselor at any time during his or her jail stay.

After First Appearance, the clerk will process your future court appearances.  You can find those clerk court appearances at the Clerk of Court website: www.clerk.org.  The next appearance after the First Appearance is the arraignment.  Usually, the arraignment is three to five weeks after the first appearance.  If an inmate has a public defender, the inmate can contact the Public Defender’s Office, which has an open phone line for inmate use.  They can also complete a request form or write a letter to public defenders.

Corrections staff cannot provide any legal information to inmates.  However, they can provide assistance in helping inmates find out when their court date is scheduled, the charges that they face, contact information for courts, assigned judges and public defenders.

The Volusia County Jail is very aware that incarceration can be a depressing experience.  Both facilities have procedures in place for dealing with inmates who may be suicidal.  You can contact the Branch Jail at 386-254-1555 or the Volusia County Correctional Facility at 386-254-1565.

Inmates have access to medical personnel while in custody.  All inmates receive a medical exam within 14 days of admission.  However, inmates who are experiencing an illness or injury can submit a sick call slip for medical attention.  Inmates who need emergency treatment can alert a staff member.

The Volusia County Jail does not publish rules for inmate mail online.  However, most jail rules have similar mail regulations.  Generally, mail must have a full return address and a complete mailing address.  It should be from the person listed in the return address and not include mail from any third parties.

Incoming inmate mail should not include any contraband or other prohibited items.  Items that may be prohibited include: weapons, drugs, medications, anything that could be used to make a weapon, stickers, stamps, pens or pencils, bodily fluids, sexually explicit material, anything that could be used to create an escape plan, racially inflammatory material, and any type of gang-related material.

Volusia County Jail Inmate Search

The Volusia County Jail system has an inmate roster that can help you locate inmates at both of the county’s correctional facilities.  The inmate roster includes information for inmates who are currently detained as well as historical information, although details from inmates incarcerated prior to July 2009 will not include mugshots and charge data.  To find an inmate, you can search using a number of different criteria, including: first name, last name, booking number, booking date, race, sex, and date of birth.  Once you have chosen an inmate’s record, you can find out more information about the inmate, including details like the charges against the inmate and the mugshot/booking photo.

Recent Arrests

The Volusia County Jail’s inmate roster is a searchable database that allows you to look up people who have been incarcerated at the facility.  You can search using booking date, which allows you to use the roster in a manner similar to a recent arrest roster.

Jail Visitation

The Volusia County Jail facilities offer video visitation.  Visitors for inmates at either facility should check into the Video Visitation Building, which is located next to the Branch Jail at 1300A Red John Drive.  Check in ten minutes before your visitation appointment.  Late arrivals are not permitted to enter the Visitation Center.

All visits are by appointment only.  To make an appointment, call 386-226-0389.  You can schedule an appointment 24 hours a day, 7 days a week.  The phone system to schedule appointments is automated.  Appointments must be made at least 24 hours in advance. Appointments can only be made for one visiting session; multiple appointments made by the same person are prohibited.  Appointments can be made up to two weeks in advance.  Inmates may have one visitation session per day.

The visitation schedule is Tuesday through Saturday.

There are visitation rules for visitation:

All visitors must have photo identification.  Most government-issued identification is acceptable, but student identification cards are not accepted.  Juvenile visitors must have some type of identification, but it can be a birth certificate, legal custody papers, or other legal documents, not just a photo ID.  All juveniles must be accompanied by an adult visitor.  Breast feeding is not permitted during visitation. Children must be under control during visitation and cannot be left unaccompanied.

Each visit may be up to two adults and two small children.  Once a visitor leaves visitation, he or she will not be permitted to return.

The jail’s dress code is relatively liberal, but the Operations Supervisor has discretion to determine whether a person is in compliance and can ask non-compliant visitors to leave.  The dress code prohibits: see through-garments, revealing garments, short-shorts, miniskirts, cleavage-revealing clothing, strapless clothing, spandex clothing, muscle shirts, and mesh t-shirts.

Inmates cannot have visitors in the first 72 hours of incarceration.

Visitors cannot bring electronic devices to visitation, including: smart phones, iPods, tablets, cameras, and recording devices.

Inmate Phone Privileges

As with most jail facilities, the Volusia County Jail does not allow inmates to receive incoming phone calls.  In addition, the staff will not take messages to relay to the inmates.  The jail will take emergency messages, and, if they can be validated, relay them to inmates.  Inmates are permitted to make outgoing collect phone calls from telephones located in their cell blocks.

Inmate Trust Accounts / Commissary

There are several different names for inmate trust accounts, including commissary accounts and canteen accounts.  These funds are for inmates to use while incarcerated, to make purchases from the commissary or canteen.  Commissary makes things available for inmates that are not made available through the jail for free.  Some items available through commissary include hygiene items, snack foods, clothing, sodas, and writing utensils.

To place money in an inmate’s commissary account, you can drop off a money order, and only a money order, in the money order drop box in the Visitation Center.

Bail Information

There is a very specific intake and bail process at the two Volusia County Jail facilities. During the first 24 hours of jail time, a person appears in front of a judge for a first appearance hearing.  During the first appearance, the judge determines whether or not there is probable cause to detain the individual.  The judge can set a bond, or, if a bond has been set, raise the bond, lower the bond, or release a defendant on his or her own recognizance.  If the person is accused of a crime where a public defender will be appointed, then the judge will assign a public defender.

The courtroom for a first appearance is located at the Volusia County Branch Jail, located at 1300 Red John Road, in Daytona Beach.  First appearances are scheduled Monday through Friday at 1:30pm and at 8:30am on weekends and holidays.  Anyone can attend a bail hearing.  After an inmate appears at the first appearance, the inmate is taken to a Case Management orientation, where a case counselor interviews and classified each inmate based on factors including the charges against the defendant and the defendant’s criminal history.  The inmate is then assigned to a housing unit.

There is an administrative set bond schedule, which depends upon a crime.  For defendants who are arrested on a warrant, the judge who issues the warrant sets the bond.  All bonds are in effect until the time of the First Appearance.  It is only during the First Appearance that the judge can change the bond.

To post bond, you can take them to the Branch Jail.  The Branch Jail is at 1300 Red John Drive, Daytona Beach.  You can post a cash bond or use the services of a bail bondsmen to pay for bond if you are unable to pay the full amount of a cash bond.  The jail cannot recommend bail bondsmen, but you can find a list of Bail Bond Companies under the term “bail bonds” in the yellow pages in the phone book or on the internet.

Conclusion

The Volusia County Jail is actually two facilities: the Volusia County Correctional Facility and the Volusia County Branch Jail.  Generally, defendants are taken to the Volusia County Branch Jail before their first appearance and may stay there while pending trail.  Defendants who have been convicted and are serving a sentence will be at the Volusia County Correctional Facility.   The Volusia County Corrections Director is Mark Flowers and the Warden is Larry Langdon.  These two are responsible for overseeing corrections in Volusia County.
