At all jail facilities, mail is monitored.  This means that incoming mail, except for legal mail, is opened and inspected, and may be read, prior to being delivered to the inmate.  The types of content that are not allowed in jai mail include various different types of content that could lead to problems in the jail facility.  Examples of prohibited content include: sexual content, nudity, pornography, gang-related materials, depictions of weapons, racism, other types of bigotry, illegal activity, hate, or any type of mistreatment of others.  In addition, information that could be used to schedule a break from the jail is also prohibited.  This includes information about jail schedules, the exterior or interior of the jail, or other details that could be used to plan an escape.

Legal mail is not inspected in the same way as non-legal mail, because the contents of the legal mail are confidential.  (This is not true if there is a reason to believe that the legal mail is being used to transmit ongoing criminal information; in those instances, it may be subject to inspection).  Generally, legal mail will still be inspected for contraband.

There is other stuff that is prohibited in the mail.  This includes weapons, guns, drugs, prescription medications, over the counter medications, drinks, food, anything that can be used to make a weapon, oversized cards, cards with musical or moving parts, glitter, stickers, glue, plastic parts, metal parts, unidentifiable substances, bodily fluids, lipsticks, or perfumes.

In addition to regular mail, inmates at the Henry County Jail can receive publications like books and magazines.  However, you cannot send those items directly to the jail.  Instead, published materials have to be sent directly from the publisher or from an authorized distributor or bookseller.  In addition, the published materials have to follow all of the other rules about inmate mail.  Books also have to be softcover and cannot have any type of hard binding or spiral binding.  There may also be rules about the number of books or magazines that an inmate can have in their cell at one time, so want to schedule deliveries when you know an inmate is available.

Jail Visitation

The Henry County Jail offers visitation for inmates.  These visits are non-contact visits, which means that they are conducted through a partition.  Many jails are developing video visitation options.  While that was not an option at the time of publication, you should contact the jail by calling 770-288-7070 to inquire whether or not the jail has made video visitation an option.

Inmates are allowed 2 visitors per day.  Visitation hours are Monday from 9:00 am to 6:00 pm; Tuesday from 9:00 am to 6:00 pm; Wednesday from 9:00 am to 6:00 pm; Thursday from 9:00 am to 6:00 pm; and Friday from 9:00 am to 6:00 pm.

Not all people will be allowed to visit at the jail.  First, visitors need to be on an inmate’s visitor list.  This list is reviewed by the jail.  A criminal history or history of domestic violence with the inmate, including the presence of restraining orders, may prevent visitation.  If the visitor is the victim of the crime alleged against the inmate, visits may be restrained.  Recent inmates of the Henry County Jail may not be able to visit.  If you have any outstanding warrants, you may be arrested if you attempt to visit.

In addition, visitors who come to the facility will not be subject to search and must follow all rules for visitors.  Failure to submit to search or to comply with the rules for visitation will result in visitation ending.  In addition, failing to appear for a scheduled visit can result in visitation ending.

Adult visitors need to provide identification.  Minor visitors have to be accompanied by adults, and must be accompanied by the adult at all times during the visit.  There can be no unaccompanied children in the visitation area and children cannot be left in parking or other common areas of the jail facility.

Visitors cannot hand anything to the inmate, including things like glasses, medication, mail, messages, or any other type of item or package.  If you need to provide anything to an inmate, you need to contact the jail staff to see if they can transmit it to the inmate.

Visitors cannot be under the influence of alcohol or drugs when visiting.  Visitors who appear to be drunk or under the influence of drugs will not be permitted to visit, and may be prohibited from visiting in the future.

Visitors to jail facilities have to wear modest clothing, and failure to do so can result in not being permitted to visit the jail facility.  The Henry County Jail does not publish a visitor dress code.  However, general jail dress code rules for visitors require shoes and shirts for all visitors.  These dress codes also usually prohibit: cleavage revealing clothing, low-cut shirts, midriff-baring shirts, spaghetti strap shirts, tank tops, muscle shirts, clothing with obscene or offensive language, clothing that signals gang involvement, short-shorts, mini-skirts, tight clothing, see-through clothing, or mesh clothing.  In additional, all visitors are required to wear undergarments.

If you are not familiar with the jail system, you may not realize that inmates are allowed to have access to money in jail.  While they are usually prohibited from having any type of cash or other negotiable instrument, they can have access to money in inmate trust accounts.  These accounts are used to pay for expenses in the jail, including commissary and canteen services.  Commissary and canteen are just two names for the same service; a jail run store system where inmates can purchase items that are not provided by the jail.  Some of the things available in the commissary may include: food, drinks, over the counter medications, health and beauty products, shoes, clothing, hygiene items, art supplies, writing supplies, and entertainment items.

You can usually deposit money into inmate accounts by going to the jail facility.  You may also be able to make deposits on the phone, online, or by mail.  Many money processing services, like Western Union and MoneyGram, allow you to send money to an inmate for putting on an inmate account.

Bail Information

Inmates at the Henry County Jail may be eligible for bail.  Bail is money paid to the jail to secure an inmate’s release from the facility while awaiting trial.  This amount is called bond.  Bond can be paid in full.  When the full amount of bond is paid, this is known as a cash bond. When a cash bond is paid, that bond is refundable a long as a the defendant complies with conditions of release and appears at trial.  Not everyone can afford to pay the full amount of the cash bond.  When that happens, this is known as bail.  Bail means a percentage of the bond is paid.  However, this percentage is not paid directly to the court.  Instead, it is paid by a third party, which is known as a bail bondsman or surety.  This fee purchases the surety’s services, and the surety then guarantees the court to pay the full amount of bail if the inmate fails to appear at trial or comply with the conditions of bail.  This fee costs less up-front than paying the full cash bond, but there is a significant difference in the two types of bond payment. The fee paid to the bail bondsman, which is usually 10% of the bond, is non-refundable, even if the defendant complies with all of the conditions for release and appears at trial.
